1. About QueueCut
1.1 QueueCut is a trading name of ARIMX Ltd ("ARIMX", "we", "us", "our"), a private limited company registered in England and Wales. QueueCut operates a peer-to-peer marketplace mobile application that enables users to buy and sell physical queue positions at real-world locations.
1.2 QueueCut acts solely as an intermediary technology platform and is not a party to any transaction between buyers and sellers.
1.3 By using the QueueCut app, you agree to be bound by these Terms and Conditions in full.
1.4 If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions shall not be affected.
1.5 The app is provided on an "as is" and "as available" basis without warranty of any kind.
1.6 QueueCut may withdraw or suspend your right to access the app at any time, without prior notice.
1.7 Your use of the app is governed in accordance with the laws of England and Wales.
2. Eligibility
2.1 You must be at least 18 years of age to register and use QueueCut.
2.2 By creating an account, you confirm you are at least 18, have legal capacity to contract, and all information you provide is accurate.
3. The QueueCut Service
3.1 QueueCut provides a technology platform connecting Sellers (queue position holders) with Buyers (those wishing to purchase a position).
3.2 QueueCut does not own, create, sell, or supply any queue positions listed on the platform.
4. User Accounts
4.1 You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.
4.2 Notify us immediately at support@qcut.uk of any unauthorised use of your account.
4.3 QueueCut may terminate or suspend your account at any time if you are in material breach of these Terms.
5. Listings and Seller Obligations
5.1 By creating a listing, Sellers confirm they are genuinely and physically present in the queue at the stated location, the information is accurate, and they will cooperate fully with the QR verification process.
5.2 Fraudulent or false listings will result in immediate account suspension and may be reported to relevant authorities.
6. Payments and Escrow
6.1 All payments are processed by our payment provider(s) including PayPal. When a Buyer purchases a spot, funds are held in escrow until verified via the in-app QR handshake.
6.2 Upon successful completion: QueueCut retains a 10% platform fee; payment processing fees are deducted; the remaining balance is credited to the Seller's wallet; wallet funds are held for a minimum of 3 days before withdrawal.
6.3 If a swap is cancelled before completion, the payment authorisation is voided and no funds are taken from the Buyer.
7. Platform Fees
7.1 QueueCut charges a 10% platform fee plus standard payment processing fees. These fees are non-refundable once a swap is confirmed. QueueCut reserves the right to change its fee structure at any time.
8. Refunds and Disputes
8.1 Buyers are entitled to a full refund if the swap is cancelled before QR completion, or the Seller's listing is found to be fraudulent.
8.2 Disputes must be raised within 48 hours by contacting support@qcut.uk. QueueCut's decision is final.
9. Prohibited Conduct
9.1 You agree not to create fraudulent listings, harass other users, circumvent our payment systems, use bots or automated tools, engage in illegal financial activity, or create multiple accounts to evade restrictions.
10. Intellectual Property
10.1 All intellectual property rights in the QueueCut platform, brand, logo, and software are owned by ARIMX Ltd. Nothing in these Terms transfers any IP rights to you.
11. Limitation of Liability
11.1 To the maximum extent permitted by law, ARIMX Ltd will not be liable for any indirect, consequential, or special loss arising from your use of the platform. Our total aggregate liability shall not exceed the total platform fees paid by you in the 3 months preceding the claim.
12. Governing Law
12.1 These Terms are governed by the laws of England and Wales. English courts shall have exclusive jurisdiction.
